Catastrophic Burn Case Settled For $2 Million Maximum Policy Limits

Roger Carr, an Okeechobee trucker, suffered 2nd and 3rd degree burns over most of his body while on the job simply picking up cattle feed from a Dairy Feeds, Inc. a company with common ownership by McArthur Dairy. The manager and employees of Dairy Feeds never advised Roger that the feed he was picking up had caught on fire and was smoldering while in silo holding tanks for days and weeks.

When Roger arrived to load and then deliver the feed to a customer, Dairy Feeds staff was understaffed so they asked Roger to help retrieve the feed from a closed silo structure.  As Roger helped, he got very close to the structure, which exploded.  Roger was engulfed in flames and quickly airlifted to Orlando Regional Hospital. There, Roger was placed into an induced coma for three months.  His wife was told he probably would not survive. Roger defied the odds, and is alive and living as normal a life as possible.

Rubin & Rubin investigated the accident, the circumstances, worked with OSHA and other agencies in developing a compelling presentation to the insurer for Dairy Feeds, which agreed to pay the maximum coverage under its insurance policy.
